These Terms and Conditions ("Terms") outline the rules and guidelines for visiting our website, https://www.romepa.com, and engaging with our services. By accessing or using our website and services, you agree to be bound by these Terms.
 

1. Acceptance of Terms By accessing this website or utilizing any services offered by Rome Public Adjusting, you acknowledge that you have read, understood, and agree to these Terms. If you do not agree with any part of these Terms, you must not use our website or services.
 

2. Services Offered Rome Public Adjusting offers two primary service models to assist property owners with their insurance claims:

  • A. Comprehensive Public Adjusting (Full Advocacy): We provide full, comprehensive representation throughout the entire claims process, including investigation, documentation, policy interpretation, and negotiation with insurance carriers to secure the maximum and most just settlement.

  • B. Claim Investigation & Documentation Package (DIY Aid): We conduct a professional claim investigation and prepare a comprehensive documentation packet (including detailed estimates, photos, measurements, etc.) for clients who wish to manage their own claim negotiation.

3. Client Engagement and Fees

  • Initial Consultation: We offer a free, no-obligation initial claim consultation to assess your needs.

  • Formal Engagement: Engagement for any paid services (Comprehensive Public Adjusting or Claim Investigation & Documentation Package) requires a separate, written Client Service Agreement (or Public Adjuster Contract) signed by both parties. This agreement will clearly outline the specific scope of services and the applicable fee structure.

  • Fee Structure for Comprehensive Public Adjusting (Full Advocacy):

    • This service operates on a contingency fee basis. Our fee is a pre-agreed percentage (always within Georgia's legal limits) of the final claim settlement obtained due to our involvement.

    • "No Recovery, No Fee": For this service, if we do not secure a settlement for your claim, there is no fee for our core public adjusting services.

  • Fee Structure for Claim Investigation & Documentation Package (DIY Aid):

    • This service is charged on a project-specific, hourly basis. The fee is $200 per hour. For single-family dwelling claims, documentation packets typically require between 5 to 10 hours of work, resulting in a usual project cost ranging from $1,000 to $2,000. The final cost is determined by the actual hours required for your specific claim. Commercial property quotes vary greatly and will be provided on a case-by-case basis. 

    • Payment for this service is due as agreed upon in the Client Service Agreement, regardless of your subsequent claim outcome.

  • Transparency: All fees, terms, and conditions for the chosen service will be fully disclosed and agreed upon in the Client Service Agreement before any paid services commence, reflecting our commitment to transparency and justice.
     

4. Website Usage

  • Permitted Use: This website is intended for individuals and businesses seeking information about public adjusting services and engaging with Rome Public Adjusting.

  • Prohibited Conduct: You agree not to use the website for any unlawful purpose, to solicit others to perform unlawful acts, to violate any international, federal, state (including Georgia), or local regulations, rules, laws, or ordinances, or to infringe upon or violate our intellectual property rights or the intellectual property rights of others. This includes harassment, abuse, insult, harm, defamation, slander, disparagement, intimidation, or discrimination.

Intellectual Property All content on this website, including text, graphics, logos, images, and other material, is the property of Rome Public Adjusting or its content suppliers and is protected by intellectual property laws.   • Service Outcomes: While Rome Public Adjusting provides expert advocacy and documentation to support your claim, we cannot guarantee specific settlement amounts. The final settlement depends on various factors, including the specifics of your policy, the nature of your loss, and the insurance carrier's assessment. Our commitment is to diligently pursue the most just and generous recovery possible (for Full Advocacy) or provide the best possible documentation (for DIY Aid).

  • Website "As Is": Our website is provided "as is" and "as available" without any warranties, express or implied. Rome Public Adjusting does not warrant that the website will be uninterrupted, timely, secure, or error-free.

  • Limitation of Liability: To the fullest extent permitted by law, Rome Public Adjusting, its owner(s), employees, or agents shall not be liable for any direct, indirect, incidental, special, consequential, or punitive damages, including without limitation, lost profits, lost revenue, lost savings, loss of data, replacement costs, or any similar damages, whether based in contract, tort (including negligence), strict liability or otherwise, arising from your use of any of the service or any products procured using the service, or for any other claim related in any way to your use of the service or any product.

8. Termination We may terminate or suspend your access to our website immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach these Terms. The terms of our client engagements are governed by the separate Client Service Agreement.
 

9. Governing Law and Jurisdiction These Terms shall be governed and construed in accordance with the laws of the State of Georgia, without regard to its conflict of law provisions. Any legal action or proceeding arising under these Terms shall be brought exclusively in the state or federal courts located in Rome, Georgia (Floyd County), and you consent to the personal jurisdiction of such courts.
 

10. Changes to Terms & Conditions We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will try to provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion. By continuing to access or use our website after those revisions become effective, you agree to be bound by the revised terms.
